1. Who we are

SmartPacker ("SmartPacker", "we", "us") is operated by Seven Sunsets Travel LLC. By using smartpacker.app, the SmartPacker packing assistant, or related services (the "Service"), you are entering into an agreement with Seven Sunsets Travel LLC.

2. Acceptance of terms

By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age to form a binding contract, or that you have the authority to bind the organization on whose behalf you are using the Service.

3. The Service

SmartPacker provides AI-generated packing lists, destination packing guides, and related travel-planning tools. Outputs are suggestions only and may be inaccurate or incomplete; you are responsible for verifying anything relevant to your trip (visa, weather, regulations, medical needs, etc.).

4. Acceptable use

You agree not to misuse the Service. You will not:

  • use the Service for unlawful, fraudulent, or harmful purposes;
  • infringe intellectual property or privacy rights;
  • send spam or attempt to deceive other users;
  • interfere with security, probe, scan, scrape, or distribute malware;
  • attempt to reverse engineer, resell, or redistribute the Service;
  • circumvent technical limits, rate limits, or access controls.

5. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

6. Intellectual property

The Service, including software, content, branding, and documentation, is owned by Seven Sunsets Travel LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

7. Payments, subscriptions, refunds and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Refunds are handled per our Refund Policy.

8. Service level and warranties

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including lost profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (e.g., fraud or death/personal injury caused by negligence).

10. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete associated data after a reasonable period.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Seven Sunsets Travel LLC is established, without regard to conflict-of-law principles.
